Federal Court Rejects Spribes Motion

The Federal Court of Brazil has rejected Spribe’s Motion for Clarification concerning the Court’s previous decision. Aviator Studio promptly responded to the motion on August 14.

In its latest decision, the Federal Court of Brazil confirmed that the preliminary injunction remains in effect and clarified that any attempt to challenge the substance of the original decision must be pursued through the appropriate legal procedure.

Judge Arthur Pinheiro Chaves stated that, in order to properly challenge the merits of the decision, the appellant must use the appropriate procedural mechanism.

This means that Spribe’s Motion for Clarification did not result in any change to the existing decision or the effects of the preliminary injunction.

If Spribe wishes to continue challenging the decision, it may seek further review before the Federal Court of Appeals by filing an Interlocutory Appeal.

For Aviator Studio, the latest ruling is another important development in the ongoing legal proceedings. The Court’s decision leaves the preliminary injunction in place while the broader case continues through the appropriate legal channels.

Aviator Studio remains committed to protecting its intellectual property rights and the integrity of its Aviator brand, while continuing to pursue the matter through the courts.

The case remains ongoing, and Aviator Studio will continue to provide updates as further developments arise.
